PLEASE READ CAREFULLY. BY USING THE SCULPT STUDIO WEBSITE OR BOOKING SERVICES THROUGH IT, YOU AGREE TO THE FOLLOWING TERMS OF USE.

By accessing or using the Sculpt Studio website (the “Site”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions of Use (“Terms”). If you do not agree, do not continue to use the Site or book services through Sculpt Studio.

These Terms govern your use of the Site, your interaction with Sculpt Studio, and your participation in classes, sessions, or related offerings. Sculpt Studio may update, change, or modify these Terms at any time without prior notice. By continuing to use the Site, you accept the revised Terms automatically.

 

USE OF SITE & COPYRIGHT

All content on the Sculpt Studio website- including text, photos, videos, graphics, branding, and other materials (the “Content”) is protected under U.S. and international copyright law. You may view the site for personal, non-commercial use only.

You may not copy, reproduce, republish, sell, distribute, or commercially use any content without written permission from Sculpt Studio.

All trademarks and logos displayed on the Site are the property of Sculpt Studio. No license or right to use them is granted without written consent.

Sculpt Studio reserves the right to update classes, schedules, services, pricing, policies, or features at any time.

 

USER RESPONSIBILITIES

You agree not to use the Site to:

  • Upload or distribute harmful, defamatory, threatening, unlawful, or obscene content

  • Interfere with the Site’s operation or security

  • Violate copyright or intellectual-property protections

  • Post false or misleading information

  • Upload viruses, spam, advertisements, or malicious code

  • Harass or harm any user, staff, or affiliated party

Using the site means you accept and agree to all privacy, data, and service policies linked on the Sculpt Studio platform.

 

INDEMNIFICATION

You agree to indemnify and hold harmless Sculpt Studio, its owners, instructors, employees, contractors, affiliates, and agents from any claims, losses, damages, or expenses (including attorney fees) arising out of your use of the Site or participation in studio services.

Sculpt Studio may assume defense of any claim if it chooses, and you agree not to settle without written approval.

The Sculpt Studio Site may contain links to third-party websites. These links do not indicate endorsement or responsibility for external content. Use external links at your own discretion and risk.

Sculpt Studio does not monitor all user-generated content and is not responsible for user submissions, but reserves the right to remove or restrict content at any time.

 

NO WARRANTIES

THE SCULPT STUDIO WEBSITE AND ALL RELATED CONTENT ARE PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND.

SCULPT STUDIO DOES NOT GUARANTEE THAT:

  • The Site will be uninterrupted or error free

  • The Site or server will be free of viruses or security risks

  • Content will always be accurate, timely, or complete

 

Your use of the website and participation in Sculpt Studio services is at your own risk.

 

ACKNOWLEDGEMENT OF ELECTRONIC TRANSMISSION

You understand that online communications may not be private or secure. By submitting information through the Site, you acknowledge that no confidential or fiduciary relationship is created beyond these Terms.

 

JURISDICTION

These Terms are governed by the laws of the State of Idaho. Any legal dispute shall be resolved exclusively in Idaho state or federal courts.

 

PARTICIPATION WAIVER & LIABILITY RELEASE – SCULPT STUDIO

In exchange for being permitted to participate in Sculpt Studio classes, sessions, events, or physical activity (the “Activities”), I voluntarily agree to the following terms:

Assumption of Risk

​

I understand that Sculpt Studio classes involve physical exertion and may include Pilates-based strength training, mobility work, equipment usage, and elevated-temperature environments. Risks may include—but are not limited to—sprains, strains, dizziness, dehydration, fainting, increased heart rate, injury, or death. I choose to participate voluntarily and at my own pace.

 

Health and Medical Responsibility

I affirm that I am physically able to participate in Sculpt Studio classes. I have been advised to consult a physician before participating, especially if I have any:

  • Medical or cardiovascular conditions

  • Bone, joint, back, neck, or knee limitations

  • Pregnancy or exercise-related restrictions

 

I agree to stop participating if I feel discomfort, pain, light-headedness, or medical distress. I understand instructors are not medical providers and that participation is at my own discretion.

 

Waiver and Release of Liability

 

To the fullest extent permitted by law, I release and hold harmless Sculpt Studio, LLC, its owners, instructors, employees, contractors, landlords, volunteers, and affiliates (the “Released Parties”) from any injury, illness, death, property damage, or financial loss related to my participation—whether caused by negligence or otherwise.

Cancellation & Refund Policy

 

We do not offer refunds. You may cancel your class reservation up to 12 hours before start time to receive that credited back to your account. Failure to do so will result in loss of class credit. Late cancellations incur a $15 fee. No shows are charged $20. We do understand that life happens! Thank you for understanding and respecting our class policy.

 

Property & Theft

​

I am responsible for my personal belongings. Sculpt Studio is not liable for lost, stolen, or damaged items.

 

Emergency Care Consent

​

If medical attention is necessary, I consent to treatment and assume full responsibility for related costs.

 

Photo, Video & Security Consent

​

Sculpt Studio may film or photograph classes for marketing, media, or internal use. By participating, I grant permission to use my likeness for studio-related purposes without compensation, unless I request otherwise in writing.

​

I also acknowledge that the studio may use security cameras in common and workout areas for safety.

 

Legal Understanding

​

I have read and understand this agreement and waive substantial legal rights, including the right to sue. If any portion is deemed invalid, the remainder remains enforceable.
